Terms of Service & Custodial Facilitation

Master Tripartite Contract Farming Governance & Stewardship Agreement

Operational Role as Technical Agro-Custodian

CashKG Technologies Private Limited (“CashKG”) is an agricultural technical custodian and digital transaction facilitator. CashKG does not acquire, sell, or mortgage title to rural agricultural lands. All transactions represent individual, georeferenced Tripartite Contract Farming and Agroforestry Stewardship Agreements executed among the Registered Landowner, the Verified Investor/Subscriber, and CashKG as the technical and off-take facilitator.

01.Platform Facilitation & Technical Custody

By accessing CashKG (“Platform”) or participating in Tree-SIP, reserve unit allocations, or land listings, you agree to be bound by these Terms:

  • Scientific Crop Husbandry: CashKG provides soil rejuvenation protocols, certified sapling procurement (e.g. tissue-cultured Beema Bamboo, certified Melia Dubia, African Mahogany), automated drip irrigation setup, and continuous agronomy monitoring.
  • Cadastral GIS Georeferencing: Every unit allocated to an investor corresponds to a distinct, non-fungible physical grid demarcated via sub-meter GNSS coordinates on official state revenue maps.
  • Institutional Off-Take Aggregation: CashKG negotiates sovereign and industrial forward off-take pacts with verified industrial processors (e.g. Century Plyboards, NTPC Biomass Consortia, Paper & Pulp Refineries).

02.Investor Eligibility Criteria & Payment Mechanics

To reserve agroforestry units or activate recurring Tree-SIP mandates, participants must meet statutory criteria:

Legal Capacity: Natural persons aged 18+ or recognized legal entities (Corporates, LLPs, Trusts, Family Offices) holding a valid Indian PAN.
Escrow Custody: All reservation funds and SIP debits are routed through a scheduled commercial bank Escrow Account (ICICI Bank Custody) and disbursed strictly against certified agronomic planting milestones.
Micro-Unit Certificate: Upon funding confirmation, investors receive a digitally signed Allotment Deed containing georeferenced coordinates, sapling batch serial, and 30-year title audit certificate.

03.Landowner Covenants & Warranties

Rural landholders listing parcels on the CashKG Land Vault irrevocably covenant and warrant:

Boundary Preservation

Landowners must maintain physical stone markers and barbed bio-fencing aligned with the registered Cadastral survey polygon without encroachment.

Absolute Non-Encumbrance

Warrant that the land parcel is free of liens, undisclosed mortgages, tenancy disputes, or pending Land Acquisition notices.

Right of Continuous Inspection

Unrestricted right for CashKG chief agronomists, drone operators, and third-party forestry auditors to enter for soil testing and NDVI logs.

Felling & Harvest Exclusivity

Strict prohibition against premature felling, unauthorized harvesting, or pesticide application without CashKG agronomic sign-off.

04.Harvest Proceeds & Revenue Waterfall

Gross proceeds derived from certified timber log auctions, bamboo culm off-takes, and carbon insetting credit sales are disbursed strictly under the platform waterfall formula:

1. Rural Landowner Share:50% of Net Farm-Gate Harvest Value
2. Investor / Unit Holder Share:Capital Recovery + Agreed Projected Surplus
3. CashKG Facilitation & Stewardship:Platform Management Fee & Drone Telemetry Levy

05. Dispute Resolution & Arbitration

These Terms shall be construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms shall be referred to arbitration in Bengaluru, Karnataka, under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed jointly by the parties. Courts in Bengaluru shall have exclusive jurisdiction.
